– Article 3 - Determining punishment

1. Punishments are determined per article. Categories include: warnings, fines, driving bans, seizures, community service and prison sentences.
2. A punishment can never exceed what an article states.
3. A punishment can be increased in case of recidivism (repeat offence).
4. If there are multiple victims of a violent offence, 10% of the punishment is added per victim.
5. The maximum prison sentence is 240 months. If a suspect would exceed 240 months, an additional fine of € 750,- per extra month is added.
6. A punishment may be reduced due to circumstances, such as misconduct by an on-duty officer or cooperation without resistance.
7. A punishment may be partially or fully removed by a (deputy) public prosecutor.
