– Article IV-1 Hard drugs (2 OA)

1. A person is guilty when acquiring or possessing hard drugs.
2. A person is also guilty when acquiring/possessing/selling ingredients needed to produce hard drugs.
3. Sentencing is based on the total quantity found, even if spread across multiple persons.
4. The quantity as meant is aggregated per person.
5. If cooperation cannot be proven, quantities are not aggregated.
6. Sentencing is based on quantities of ingredients and end products.
7. Recidivism increases the sentence by 25%.
8. Hard drugs include: cocaine, heroin, (crystal) meth, XTC, ketamine, LSD, amphetamine, crack, mushrooms.
